1) Scope of Application
1.1 These Terms and Conditions (hereinafter “T&Cs”) of Touda Artisans (hereinafter “Seller”) apply to all contracts for the delivery of goods concluded between a consumer or business customer (hereinafter “Customer”) and the Seller regarding the products displayed in the online shop. Any inclusion of the Customer’s own terms and conditions is hereby rejected, unless expressly agreed otherwise.
1.2 For the purposes of these T&Cs, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business, or professional activity.

3) Conclusion of Contract
3.1 The products displayed in the online shop do not constitute a binding offer by the Seller but serve as an invitation for the Customer to submit a binding offer.
3.2 The Customer may submit the offer via the online order form integrated into the shop. By clicking the button that completes the ordering process, the Customer submits a legally binding contractual offer.
3.3 The Seller may accept the offer within five days by:

sending an order confirmation by e-mail, or
-
delivering the ordered goods, or
-
requesting payment from the Customer after the order is placed.
The acceptance period begins the day after the Customer submits the offer and ends at the close of the fifth day thereafter.
3.4 If the Customer selects a payment method offered by PayPal, payment processing is carried out via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under PayPal’s applicable terms.
3.5 The contractual language is German.
4) Right of Withdrawal
4.1 Consumers residing in the European Union have a statutory right of withdrawal of 14 days.
4.2 Details are set out in the cancellation policy.
4.3 For Customers outside the European Union, the statutory provisions of their country of residence apply in addition to these T&Cs.
5) Prices and Payment Terms
5.1 All prices displayed in the shop are final prices. VAT is not shown, as the Seller is based in Morocco.
5.2 Shipping is free of charge. Please note: For deliveries outside Morocco, additional customs duties or import taxes may apply, which must be borne by the Customer. These charges are not included in the purchase price.
5.3 Accepted payment methods are indicated in the online shop. Currently PayPal and bank transfer are available; further methods (e.g., credit card, Shop Pay) will follow.
5.4 In the case of bank transfer, payment is due immediately upon conclusion of the contract.
6) Delivery and Shipping Conditions
6.1 Shipping is exclusively from Morocco via DHL Express or Aramex. Delivery time is generally 2–4 business days, depending on customs clearance and the recipient country.
6.2 If delivery fails due to reasons attributable to the Customer (e.g., incorrect address, failure to collect), the Customer shall bear any resulting additional costs.
6.3 Returns must generally be sent back to Morocco. In exceptional cases and upon prior agreement, a return address in Germany may be provided.
7) Retention of Title
The goods remain the property of the Seller until payment has been made in full.
8) Liability for Defects (Warranty)
8.1 Statutory warranty rights apply.
8.2 Consumers are requested to report obvious transport damage immediately to the carrier and inform the Seller. Failure to do so does not affect statutory rights.
9) Redemption of Promotional Vouchers
Conditions remain applicable as previously stated.
10) Applicable Law
The law of the Kingdom of Morocco applies.
For consumers residing in the EU, the mandatory consumer protection provisions of their country of residence also apply.
11) Alternative Dispute Resolution
The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not offer this option.
